In Barletta Heavy Div., Inc. v. Travelers, the Massachusetts federal district court rejected the policyholder's claim that an insurer's duty to defend requires the insurer to pay for offensive suits undertaken voluntarily by the insured, even where a successful outcome in that suit would limit the insurer's coverage liability.

The Chief Magistrate Judge for the United States District Court for the District of Massachusetts granted Brian McDonough's motion for summary judgment dismissal of an age discrimination claim lodged against his client, a national designer and manufacturer of detention facility products. Zavalianos v. Southern Folger Detention Equipment Co., LLC, 2012 WL 4023624 (D.Mass. Sept. 11, 2012)

ZMC Clients Obtain $4.5 Million Jury Verdict for Fraudulent Transfer and Corporate Disregard
A Federal jury returned a verdict in favor of ZMC clients for $4.5 million dollars in a reach and apply action based on fraudulent transfer and corporate disregard. The award will partially satisfy a substantial judgment obtained earlier in the Massachusetts Courts.

ZMC Client Awarded $300,000 for Successfully Defending Coverage Case
The United States District Court for the Virgin Islands awarded ZMC's client, Lexington Insurance Company, $300,000 in attorneys' fees and costs for successfully defending against an insurance coverage lawsuit. Lexington was granted summary judgment by the court in 2009 and in 2011 the Third Circuit affirmed. The fees were awarded under the Virgin Islands' fee shifting statute. Mark Cohen represented Lexington.

ZMC Makes New Law in Rhode Island
Zelle McDonough & Cohen has overturned Rhode Island's strict liability rule for extra-contractual damages where an insurer refuses to settle a claim against its insured within the policy limit. Tony Zelle argued the case for Travelers in the Rhode Island Supreme Court: DeMarco v. Travelers Ins. Co., WL 2697038 (R.I. July 12, 2011).

Third Circuit Affirms Judgment for ZMC Client
The Third Circuit Court of Appeals has affirmed the judgment of a Virgin Islands district court judge for ZMC's client, Lexington Insurance Company. The Third Circuit agreed that Lexington did not breach its contract with an insured by filing an interpleader action rather than paying the policy limits to the insured over another insured's objection. Mark Cohen represented Lexington. See HOVENSA LLC v. Lexington Ins. Co., 2011 WL 2631855 (3d Cir. July 6, 2011).

ZMC Wins Bad Faith Case Against Property Insurer
A Massachusetts trial court dismissed an insured's bad faith claim against ZMC's client based on an alleged unfair and deceptive investigation following a New York court's determination that no coverage was owed under a property policy for a pier collapse.

Defense Verdict for ZMC Client in Arbitration
Mark Cohen and Donna Hess secured a defense verdict in an insurance coverage arbitration arising from the collapse of a Vertical Belt System at a coal mine in Illinois. The panel found that the products exclusion in the Architects and Engineers Professional Liability policy precluded coverage. The insured had sought more than $1 million in damages.

Pennsylvania Appellate Court Affirms Summary Judgment Ruling for ZMC Client
The Pennsylvania Superior Court affirmed a decision granting summary judgment to ZMC's client, Lexington Insurance Company, in a coverage and bad faith lawsuit arising from a national discrimination class action. The court found that the claim was first made before the policy period. The Superior Court further found that Lexington's correct decision to decline coverage prevented any bad faith claim against it. R.J. Maselek handled the case at both the trial court and appellate levels.

Jury Verdict Against Merrill Lynch Leads to Bench Trial on Punitive Damages and Sanctions
ZMC obtained an $8.6 million compensatory damages verdict against Merrill Lynch in June 2009 based on the broker's aiding and abetting its customer in high risk option trading with escrow funds. This initial verdict will be followed this June by a trial on punitive damages and sanctions against Merrill Lynch and its law firm.

Brian McDonough obtained summary judgment dismissal of an action against Commerce and Industry Insurance Company and AIG Domestic Claims, Inc. in May 2009. The suit included claims of unfair insurance practices and fraudulent inducement based upon alleged misrepresentations by claims handlers regarding coverage for purported rehabilitation services provided by a brain injury treatment facility to an injured employee, and sought actual and punitive damages in excess of $750,000, plus attorney fees.

ZMC Prevails on Insurance Coverage and Bad Faith Issues in First Circuit
In an opinion issued in December 2008, Mark Cohen represented National Union Fire Insurance Company in the successful appeal affirming a defense verdict obtained by Tony Zelle in a bad faith and insurance coverage case in the District of Massachusetts. National Union Fire Ins. Co. of Pittsburgh, Pa. v. West Lake Academy, 548 F.3d 8 (1st Cir. 2008).

Defense Verdict for ZMC Attorneys
Mark Cohen, R.J. Maselek and Donna Hess obtained a defense verdict for Lexington Insurance Company in Lifestyles v. Lexington Insurance Company, a case arbitrated in September 2008 before the American Arbitration Association. The arbitration concerned the availability of coverage under an Employment Practices Liability Insurance policy and whether the insurer was estopped from raising coverage defenses.
